1. Agreement to Terms

Welcome to Polyoanall Travel. These Terms of Service ("Terms") govern your access to and use of the Polyoanall Travel website, services, and any related applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Services.

These Terms constitute a legally binding agreement between you and Polyoanall Travel Pty Ltd (ABN: 45 678 901 234), referred to as "Polyoanall Travel," "we," "us," or "our."

2. Our Services

Polyoanall Travel provides travel agency services, including but not limited to:

  • Guided tours and travel packages in Australia
  • Custom itinerary planning
  • Accommodation booking
  • Transportation arrangements
  • Activity and excursion bookings
  • Travel information and resources

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of our Services.

3. Booking and Payments

3.1 Booking Process

When making a booking through our Services, you agree to provide accurate, current, and complete information. A booking is not confirmed until you receive a written confirmation from us and any required payment has been processed.

3.2 Prices

All prices are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. Prices are subject to change until a booking is confirmed. We reserve the right to correct pricing errors at any time.

3.3 Payments

Payment terms vary depending on the service booked:

  • For most tours and packages, a deposit of 20% is required at the time of booking, with the balance due 60 days prior to departure.
  • For bookings made within 60 days of departure, full payment is required at the time of booking.
  • Different payment terms may apply for custom packages, which will be specified in your booking confirmation.

Payment can be made by credit card, direct bank transfer, or other methods specified at the time of booking. By providing your payment details, you authorize us to charge the applicable amount to your payment method.

4. Cancellation and Refund Policy

4.1 Cancellation by You

If you need to cancel a booking, the following cancellation fees apply:

  • More than 60 days before departure: 10% of total booking amount
  • 30-60 days before departure: 25% of total booking amount
  • 15-29 days before departure: 50% of total booking amount
  • 0-14 days before departure: 100% of total booking amount

All cancellations must be made in writing to [email protected].

4.2 Cancellation by Us

We reserve the right to cancel a tour or service for any reason, including insufficient participants or force majeure events. If we cancel a tour, you may choose between:

  • A full refund of all payments made
  • An alternative tour of comparable standard, if available
  • A credit for future travel with us

We are not responsible for any incidental expenses or consequential losses that you may have incurred as a result of the cancelled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment.

4.3 Changes to Bookings

If you wish to make changes to a confirmed booking, we will make reasonable efforts to accommodate your request. An administration fee of $50 AUD per change may apply, in addition to any costs imposed by suppliers.

5. User Conduct

When using our Services, you agree to:

  • Comply with all applicable laws and regulations
  • Provide accurate and truthful information
  • Maintain the confidentiality of any account credentials
  • Promptly notify us of any unauthorized use of your account
  • Not use our Services for any illegal or unauthorized purpose
  • Not interfere with or disrupt our Services or servers
  • Not attempt to gain unauthorized access to any part of our Services
  • Not use our Services to transmit harmful code or material

We reserve the right to terminate or suspend your access to our Services for violations of these Terms or for any other reason at our sole discretion.

6. Intellectual Property

All content on our website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Polyoanall Travel or its content suppliers and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

The Polyoanall Travel name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Polyoanall Travel or its affiliates. You may not use such marks without our prior written permission.

7. Disclaimers

YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that our Services will meet your requirements, be available on an uninterrupted, timely, secure, or error-free basis, or be accurate, reliable, complete, legal, or safe.

We do not guarantee the accuracy, completeness, or reliability of any information or content provided through third-party sources, including but not limited to information about accommodations, transportation, activities, or other travel services.

Travel involves risks, and we recommend that all travelers obtain comprehensive travel insurance and consult relevant government advisories before making travel decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POLYOANALL TRAVEL, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

Our maximum liability to you for any claim arising out of or relating to these Terms or our Services, regardless of the form of the action, is limited to the amount paid by you to us for the specific service from which the claim arose.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or consequential damages, so some of the above exclusions may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Polyoanall Travel, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

10. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of New South Wales, Australia, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of Australia or the courts of New South Wales, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Changes to Terms

We may revise these Terms at any time by updating this page. All changes are effective immediately when posted and apply to all access to and use of the Services thereafter.

Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
